Terms of service

These terms govern the use of the Alpy AI platform (“Alpy”, the “Service”). Alpy and Alpy AI are commercial names of NEXPA SERVICES (“we”), which is the contracting party. By creating an account or using the Service you accept them on behalf of the business you represent.

1. The Service

Alpy provides software for short-term rental operators - channel management, calendars and rates, a unified guest inbox including WhatsApp Business messaging, message automation, cleaning and supplier coordination - together with access to local service providers where available. Features may evolve; we will not remove core functionality you rely on without reasonable notice.

2. Accounts and teams

The account owner is responsible for the users they invite, for keeping credentials confidential, and for ensuring their team uses the Service lawfully. You must provide accurate business information and keep it current.

3. Your content and your guests’ data

You keep all rights to the data you bring into Alpy. You grant us the licence needed to host, process and transmit it to operate the Service. For guest and booking data you are the data controller and we are your processor under our privacy policy and data-processing terms; you warrant that you have a lawful basis for the guest data you import and for the messages you send, including WhatsApp messages, and that you honour guests’ opt-out requests.

4. Connected platforms

Connecting booking channels, a channel manager, a PMS, an email sender or WhatsApp means you also accept those platforms’ own terms (for WhatsApp: Meta’s WhatsApp Business Terms and Messaging policies, including template approval and per-message pricing billed by Meta). You are responsible for the content of messages sent through your connected accounts. Alpy never issues refunds or moves money on your behalf; payment providers you connect act under your agreements with them.

5. Acceptable use

No unlawful content, spam, harassment, attempts to access other tenants’ data, reverse engineering, or circumvention of rate limits and security measures. We may suspend an account that endangers the platform or other customers, and will tell you why.

6. Fees

Fees, plans and any usage-based charges are those agreed in your order or shown in your account. Third-party charges (for example Meta’s WhatsApp conversation fees, channel commissions, payment-provider fees) are yours and are not included.

7. Availability, support and backups

We aim for continuous availability with maintenance announced in advance when possible, and keep encrypted daily backups. Support is by email at yam@alpyai.com.

8. Warranties and liability

The Service is provided with reasonable skill and care. To the extent permitted by law we exclude implied warranties, and our aggregate liability for any claim in a contract year is limited to the fees you paid us in the preceding 12 months. We are not liable for indirect loss, loss of bookings caused by third-party platforms, or for content you send. Nothing limits liability that cannot be limited by law.

9. Term and termination

Either party may terminate on 30 days’ written notice. We may terminate immediately for material breach not cured within 15 days of notice. On termination you can export your data for 30 days, after which it is deleted as described in the privacy policy.

10. Law and courts

French law applies. Disputes not resolved amicably go to the competent courts of Aix-en-Provence, France, without prejudice to mandatory consumer rules where they apply.
